RE: The tariff classification of metalized shred from China

Dear Mr. Warren:

In your letter dated April 16, 1999, you requested a tariff classification ruling on behalf of Betta Products Inc.

The subject merchandise is described as metallic shred, of polyethylene tetraflouride, man-made fiber, measuring under 5 mm in width. A sample of the shred was submitted. It is packaged in a plastic bag measuring about 5 inches by 8 inches. The shred consists of strips measuring under 5 mm in width and approximately 12 inches in length. The bag is sealed and marked “Made in China.

The applicable subheading for the metalized shred will be 5605.00.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for metalized yarn...strip or the like of heading 5404 or 5405, combined with metal in the form of thread, strip or powder or covered with metal: metal coated or metal laminated man-made filament or strip or the like. The rate of duty will be 11.2 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
